Let me understand this -- the detainees at Gitmo have distinct pads and envelopes that are set aside for attorney-client communication and the guards aren't allowed to read anything written on that paper or put in those envelopes?

Have we completely lost our minds? Because someone somewhere sure has.

I simply do not understand this framing of these men as "criminal defendants." Gitmo is not Attica, and these men are not there because they are accused of committing crimes.

But if it is absolutely unavoidable that they be given the same rights as criminal defendants, how can we do so while losing sight of the fact that they are also terrorists?

Let them communicate with their attorneys, if they have to. But find a system that ensures they are only communicating with the attorneys.

Davod refers to Lynne Stewart, who ran a messenger service for the Islamic Group while "acting" (I used the term advisedly) as the blind Sheik Omar Abdel-Rahman's attorney. How do you "find a system that ensures they are only communicating with the attorneys"? Eavesdrop on all attorney-client conferences? You can't do that; there's no system that will stop the next Lynne Stewart. (Note, by the way, the stock description of Stewart by numerous leftists, even after her conviction for abusing her status to further terrorism, as a "civil rights" attorney.)

The question continues to be: do you treat them (act as if) they are criminals? I think terrorism occurs along a spectrum, from crime on one end to something akin to war that has to be dealt with in that frame on the other end. We framed terrorism strictly in a criminal justice frame in the '90s EVEN AS THE TERRORISTS ESCALATED, hence putting the FBI as the lead agency. That has all sorts of implications (for example in terms of treating the sites of terrorist attacks as crime scenes, places where you gather evidence for criminal prosecutions.) There may well be people who ought be treated as criminals and put into the criminal justice system and given those rights, but one of the things to remember is that the presumption of innocence is not self-evident. PRESUMPTION is an argumentative concept, it's what tells you who has the burden of proof, and you make the determination going in where you CHOOSE to place it. The old saw that we would prefer one guilty man go free yahda yahda -- that is what guided our PLACEMENT of presumption, and it's an entirely appropriate one for the criminal justice system. It is NOT an appropriate one for dealing with terrorists who are further down the spectrum from criminals, for the simple reason that we are not prepared (I would think) to see them go free.
